4. SMS/Text Messaging Terms (A2P Compliance)

SMS/Text messages are used by Millett Pools to send marketing promotions as well as send confirmations of appointments or cancelations of appointments. If you choose to opt in to receive SMS/text messages from Millett Pools, the following terms apply.

Program Description

By opting in, you may receive text messages related to customer service, appointment reminders/updates, project or service notifications, and (where you separately consent) promotional or marketing messages.

Consent

Consent is not a condition of purchase. You authorize Millett Pools to send text messages (SMS or MMS messages) to the mobile number you provided at time of signup.

Message Frequency / Rates

Message frequency may vary. Standard message and data rates may apply. Check with your wireless provider for details.

Opt-Out

You can opt out of text (SMS or MMS) messages at any time by replying STOP to any message. After you send a STOP message, you may receive a confirmation text message, and you will no longer receive SMS messages from us unless you opt in again.

To the fullest extent permitted by law, Millett Pools will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Site or any communications sent through the Site or SMS program.If we are found liable for any claim related to the Site, our total liability will be limited to the amount you paid to us through the Site in the twelve (12) months prior to the event giving rise to the claim, or $100, whichever is greater (unless applicable law requires a different amount).
